By registering on whoosme the user states and acknowledges he/she is at least 14 years of age and accepts the following terms of use, undertaking to comply with them when using the services offered by whoosme.
Rules of Use.
By registering on whoosme the user becomes the holder of a licence valid for the entire world, which is non-exclusive, revocable at any time and not transferable, to use the services offered from time to time on the site via a web browser or other technology permitted by whoosme (therefore to the exclusion of scraping, spidering, crawling for example). Users are free to use the services offered by whoosme as they wish, apart from complying with the following basic rules of decorum and common sense:
- do not break current laws;
- do not create 2 or more accounts for the same user;
- do not publish messages containing false, misleading, offensive, confidential information or information that is contrary to public order or good morals;
- do not publish content subject to the intellectual or industrial property rights of third parties without the due prior authorisation; respect whoosme's privacy policy;
- do not subvert or attempt to subvert the security measures adopted by whoosme or orders for suspension or exclusion from the services offered adopted by whoosme
Access Keys.
To access the services offered by whoosme, each user must register by providing his/her e-mail address and generating an original password associated with it. The user assumes all associated liabilities and accepts responsibility for all actions completed through authentication achieved using his/her access keys. Where the user can no longer access his/her whoosme account through the effect of the illegitimate use of his/her access keys by third parties, he/she must inform whoosme immediately of this via e-mail by writing to info@whoosme.com.
Paid Services.
The paid services on whoosme are activated only on the user's express request and requests may be revoked or cancelled at any time without additional charges. When requesting paid services, the user accepts that whoosme will process the account details for the provision of the services as well as the credit card details (or other means of payment) or that it may send this data to third parties which whoosme appoints for the provision of the paid services.
Abuse Notification.
The user may notify whoosme of abuse by another user (or a violation of these Conditions of Use) by using the appropriate buttons on the site or via e-mail by writing to info@whoosme.com. With users’ help, we undertake to make the site operate correctly and in respect of the rights of everyone.
Authentication Credentials.
To be able to access the services, you will be asked to choose a user ID and password on first accessing the site. The password and the user ID are strictly personal, must be kept private and must in no event be communicated to third parties, not even casually. The user is identified by associating the user ID and password in a unique way and therefore you acknowledge that each access to the site made using your authentication credentials means that you will be directly responsible for the relevant conduct.
Site Content.
Each user is and shall remain owner of the original content published on whoosme. whoosme shall raise no claim or right over the content legitimately published by users. Without prejudice to the above, it is agreed that the site, including text, images, sounds, brands, layout, software, etc. shall be the exclusive property of whoosme or third-party holders which license whoosme accordingly. In light of the above, the user undertakes not to copy, amend, proliferate or use the content of the site in an illegitimate way, including that published by other users, without prior authorisation.
Guarantees and Limitations of Liability.
whoosme allows users to issue evaluations and communicate without any human intervention (mere conduit). The services are in fact provided automatically by means of computer tools. whoosme is not therefore responsible for illegitimate use or undue appropriation by a user of material or content loaded on the site by another user. whoosme is not an intermediary of services or manpower and is not responsible for unauthorised or unlawful use by the users of the services provided. In consideration of the complexity of the site, whoosme cannot guarantee and does not guarantee continual and uninterrupted access to the services or their correct operation. whoosme makes periodic backups of the entire site in order to avoid losses or changes to the content and information uploaded by users. However, whoosme does not guarantee the preservation of content uploaded by users of the site.
Withdrawal.
The user may at any time withdraw from these conditions of use by cancelling his/her registration. In the same way, whoosme may at any time withdraw from this agreement by suspending the supply of the services to a particular user. Without prejudice to the provisions of law and the privacy policy, in the event of withdrawal or other cause of suspension to the supply of the services whoosme is not required to return a copy of the material uploaded on the site to the user and is authorised to maintain a copy of the content and information uploaded on the site by the user for a maximum period of two years. This material will not be used in any way and will not be accessible to third parties in any way and, at the end of the 2 years, will definitively be deleted from the whoosme databases, unless required by provisions of law or orders of the authority.
Legislation and Disputes Resolution.
These Conditions of Use are regulated by Italian law. With the exception of the case where, by law, the court of the residence of the user has jurisdiction, for any disputes regarding the interpretation, execution and compliance with these Terms of Use, the Court of Rome, Italy will have exclusive jurisdiction.
Miscellaneous.
The indications of these conditions of use represent the entire agreement between the user and whoosme. Where one clause of these conditions of use is rendered null or ineffective, the nullity or inefficacy shall not extend to the remaining provisions of the agreement. Failure to exercise any of its entitlements by whoosme does not form a renouncement of acting against third parties for the violation of the commitments contained in these Terms of use. whoosme, within the sphere of corporate operations, may transfer this agreement to third parties and any monies due arising from the use of the services. These Terms of Use and Privacy Policy may undergo variations over time including as a result of changes in the legislative framework. In such event whoosme undertakes to give prompt notification to the users by offering to provide them with all the clarifications necessary. Any communication must be made by writing via e-mail (see here the whoosme e-mail addresses). whoosme may communicate with the user via the e-mail address provided during registration or via the other contact details provided.
